ورفضت محكمة العدل الأوروبية 12 من أصل 13 طعناً قدمتها شركات طيران ضد غرامات فرضتها المفوضية الأوروبية بسبب تحديد أسعار بشكل غير قانوني.

وقبل القضاة في لوكسمبورغ الطعن المقدم جزئياً، إذ حدثت أخطاء في حساب الغرامة المفروضة عليها، وتم تخفيض الغرامة.

وكانت المفوضية الأوروبية قد فرضت العقوبات بسبب المشاركة في تكتل تسعيري بين عامي 1999 و2006، وغطى التكتل الرسوم الإضافية على الوقود والأمن، إضافة إلى رفض دفع عمولات لوكلاء الشحن على هذه الرسوم الإضافية.

ويضع الحكم الصادر اليوم، حداً لنزاع قانوني استمر 15 عاماً، وتم إلغاء قرار المفوضية الأولي لعام 2010، مما أدى إلى حكم منقح في عام 2017 وتم تأييده الآن.

The European Court of Justice rejected 12 out of 13 appeals filed by airlines against fines imposed by the European Commission for illegal price-fixing.

The judges in Luxembourg partially accepted the appeal, as there were errors in the calculation of the imposed fine, leading to a reduction in the penalty.

The European Commission had imposed the penalties for participation in a price-fixing cartel between 1999 and 2006, which covered additional charges for fuel and security, as well as the refusal to pay commissions to freight agents on these additional charges.

Today’s ruling puts an end to a legal dispute that lasted 15 years, and it annulled the Commission’s initial decision from 2010, leading to a revised ruling in 2017 that has now been upheld.
